Citation and commencement

1. This Order may be cited as the Veterinary Surgeons (Examination of Commonwealth and Foreign Candidates) (Amendment) Regulations Order of Council 2018 and comes into force on 1st October 2018.

Approval

2. The Regulations set out in the Schedule are approved.

Article 2

SCHEDULEThe Veterinary Surgeons (Examination of Commonwealth and Foreign Candidates) (Amendment) Regulations 2018

The Council of the Royal College of Veterinary Surgeons in exercise of powers conferred by section 6(4) of the Veterinary Surgeons Act 1966 makes the following Regulations.

1.The Veterinary Surgeons (Examination of Commonwealth and Foreign Candidates) Regulations 2005 are amended as follows.

2. In regulation 2—

(a)in paragraph (1)—

(i)after the definition of “Examination Appeals Committee” insert—

““examination fee” is to be interpreted in accordance with Regulation 9(1);”;

(ii)in the definition of “statutory examination”, after “of the Act”, insert “and a reference to any part of the statutory examination is to be interpreted in accordance with Regulation 4(3)”; and

(b)in paragraph (2) omit “, and references in these Regulations to “the Schedule” mean the Schedule to these Regulations”.

3. In regulation 4—

(a)for paragraph (3), substitute—

“(3)The statutory examination is in two parts—

(a)written examination; and

(b)clinical, practical examination.”;

(b)in paragraph (4)—

(i)for “each of the written examinations,” substitute “the written examination”; and

(ii)for “clinical, oral and practical examinations” substitute “clinical, practical examination”; and

(c)in paragraph (5)—

(i)for “examinations”, in both places, substitute “examination”;

(ii)omit “oral and”; and

(iii)omit “in any particular subject”.

4. Omit regulation 5.

5. In regulation 6, for “or all of the subjects referred to in Regulation 4(1)” substitute “part of the statutory examination”.

6. For regulation 7 substitute—

“7.—(1)Subject to any appeal under Regulation 6, where any candidate fails to pass the clinical, practical examination the examiners must make a report to the Education Committee which, if the condition in paragraph (2) is met, may withdraw the right of that candidate to sit the statutory examination.

(2)The condition is met if the candidate has, on three or more occasions, failed—

(a)the clinical, practical examination;

(b)where the candidate sat the statutory examination prior to 1 January 2019, any part of the clinical, oral and practical examinations that formed part of the statutory examination at that time;

(c)any combination of sub-paragraphs (a) and (b).”.

7. For regulation 9 substitute—

“9.—(1)The fee for sitting the statutory examination is £2,500, which comprises an examination fee of £2,200 and an administration charge of £300.

(2)No candidate is permitted to undertake any part of the statutory examination until he has paid the fee for sitting the statutory examination.”.

8. In regulation 10(1)—

(a)omit “, or any subject thereof,”;

(b)for “appropriate fee minus the administration charge,” substitute “examination fee”; and

(c)for “appropriate fee, minus the administration charge” substitute “examination fee”.

9. Omit the Schedule (fees for sitting the whole or part of the statutory examination).
