The Maritime Transport Access to Trade and Cabotage (Revocation) (EU Exit) Regulations 2019

Coming into force in accordance with regulation 1

The Secretary of State makes these Regulations in exercise of the powers conferred by section 8(1) of the European Union (Withdrawal) Act 2018( 1 ).

In accordance with paragraph 1(3) of Schedule 7 to that Act, a draft of this instrument has been laid before Parliament and approved by a resolution of each House of Parliament.

Citation and commencement

1. These Regulations may be cited as the Maritime Transport Access to Trade and Cabotage (Revocation) (EU Exit) Regulations 2019 and come into force on exit day.

Revocation of Council Regulation (EEC) No 2919/85

2. laying down the conditions for access to the arrangements under the Revised Convention for the navigation of the Rhine relating to vessels belonging to the Rhine Navigation is revoked. Council Regulation (EEC) No 2919/85

Revocation of Council Regulation (EEC) No 4055/86

3. applying the principle of freedom to provide services to maritime transport between Council Regulation (EEC) No 4055/86 member States and between member States and third countries is revoked.

Revocation of Council Regulation (EEC) No 4057/86

4. on unfair pricing practices in maritime transport is revoked. Council Regulation (EEC) No 4057/86

Revocation of Council Regulation (EEC) No 4058/86

5. concerning coordinated action to safeguard free access to cargoes in ocean trades is revoked. Council Regulation (EEC) No 4058/86

Revocation of Council Regulation (EEC) No 3921/91

6. laying down the conditions under which non-resident carriers may transport goods or passengers by inland waterway within a Council Regulation (EEC) No 3921/91 member State is revoked.

Revocation of Council Regulation (EEC) No 3577/92

7. applying the principle of freedom to provide services to maritime transport within Council Regulation (EEC) No 3577/92 member States (maritime cabotage) is revoked.

Revocation of Council Regulation (EC) No 1356/96

8. Council Regulation (EC) No 1356/96 on common rules applicable to the transport of goods or passengers by inland waterway between member States with a view to establishing freedom to provide such transport services is revoked.

Revocation of Council Regulation (EC) No 789/2004

9. on the transfer of cargo and passenger ships between registers within the Community and repealing Council Regulation (EEC) No 789/2004 is revoked. Council Regulation (EEC) No 613/91

Revocation of Council Decision 83/573/EEC

10. Council concerning counter-measures in the field of international merchant shipping is revoked. Decision 83/573/EEC

Revocation of Decision 167/2006/EC

11. Decision No 167/2006/EC of the European Parliament and of the Council concerning the activities of certain third countries in the field of cargo shipping is revoked.

Amendment of Annex XIII to the EEA agreement

12. Paragraphs 43, 43a, 43b, 53, 53a, 56q, 57, 58 and 59 of Annex XIII to the EEA agreement are omitted.
