The Taking Control of Goods (Amendment) (Coronavirus) Regulations 2020

The Lord Chancellor makes the following Regulations in exercise of the powers conferred by sections 77(4) and 90 of the Tribunals, Courts and Enforcement Act 2007( 1 ):
Citation, commencement and saving provision
(2) Nothing in these Regulations affects any enforcement action taken prior to the coming into force of these Regulations.
Amendments to the Taking Control of Goods Regulations 2013
2. —(1)The Taking Control of Goods Regulations 2013( 2 ) are amended as follows.
(2) In regulation 2 (general interpretation), omit the definition of “the 2020 Regulations”.
(3) In paragraph (1) of regulation 52 (minimum amount of net unpaid rent for CRAR to become exercisable), for “paragraph (2)” substitute “paragraphs (2) and (2A)”.
(4) For regulation 52(2), substitute—
“ (2) During the relevant period, the minimum amount of net unpaid rent for the purpose of section 77(3)(a) of the Act is an amount equal to—
(a) 276 days’ rent where the notice of enforcement is given on or before 24th December 2020; and
(b) 366 days’ rent where the notice of enforcement is given on or after 25th December 2020.
(2A) During the relevant period, the minimum amount of net unpaid rent for the purpose of section 77(3)(b) of the Act is an amount equal to—
(a) 276 days’ rent where the goods are taken control of for the first time on or before 24th December 2020; and
(b) 366 days’ rent where the goods are taken control of for the first time on or after 25th December 2020. ” .
(5) In regulation 52(3), for “paragraph (2)” substitute “this regulation”.
