The Sentencing Act 2020 (Commencement No. 1) Regulations 2020

The Secretary of State, in exercise of the powers conferred by section 416(1) of the Sentencing Act 2020( 1 ) and section 104 of the Deregulation Act 2015( 2 ), makes the following Regulations.

Citation and commencement

1. These Regulations may be cited as the Sentencing Act 2020 (Commencement No. 1) Regulations 2020 and come into force on 1st December 2020.

Commencement of the Sentencing Act 2020

2. The date specified for the purposes of section 416(1) of the Sentencing Act 2020 is 1st December 2020.

Amendment of the Sentencing Act 2020

3.The Sentencing Act 2020 is amended in accordance with regulation 4.

4. β€”(1) In subsection (1) of section 2 (application of Code), for β€œthe commencement date” substitute β€œ1 December 2020”.

(2) In subsection (3) of section 120 (general power of Crown Court to fine offender convicted on indictment), for β€œthe commencement date” substitute β€œ1 December 2020”.

(3) In subsections (1) and (5) of section 244 (offender subject concurrently to detention and training order and sentence of detention in a young offender institution), for β€œthe commencement date” substitute β€œ1 December 2020”.

(4) In subsections (1) and (4) of section 245 (offender subject concurrently to detention and training order and other sentence of detention), for β€œthe commencement date” substitute β€œ1 December 2020”.

(5) In section 416 (commencement)β€”

(a) in subsection (1), for β€œa date specified by the Secretary of State by regulations” substitute β€œ1 December 2020”;

(b) in subsection (5), for β€œthe commencement date” substitute β€œ1 December 2020”;

(c) in subsection (7), for β€œthe commencement date” substitute β€œ1 December 2020”.

(6) In section 417 (commencement of Schedule 22)β€”

(a) in subsection (4), for β€œthe commencement date”, in each place it occurs, substitute β€œ1 December 2020”;

(b) in subsection (9) omit β€œor, if later, on the commencement date”.

(7) In Schedule 24 (consequential amendments)β€”

(a) in paragraph 33(1)(a), for β€œthe commencement date” substitute β€œ1 December 2020”;

(b) in paragraph 220(2)(b), for β€œthe commencement date within the meaning of the Sentencing Act 2020” substitute β€œ1 December 2020”;

(c) in paragraph 312, for β€œthe commencement date” substitute β€œ1 December 2020”;

(d) in paragraph 447, for β€œthe commencement date” substitute β€œ1 December 2020”.

(8) In Schedule 27 (transitional provisions and savings)β€”

(a) in paragraph 7(1)(b), for β€œthe commencement date” substitute β€œ1 December 2020”;

(b) in paragraph 10(1)(b), for β€œthe commencement date” substitute β€œ1 December 2020”;
