The Heavy Commercial Vehicles in Kent (No. 1) (Amendment) Order 2020

Coming into force in accordance with article 1(b)

The Secretary of State makes the following Order in exercise of the powers conferred by sections 90B(2) and 90E(3) of the Road Traffic Offenders Act 1988( 1 ) (“the 1988 Act”) and section 8(1) to (3) of the Traffic Management Act 2004( 2 ) (“the 2004 Act”).

The Secretary of State is satisfied, in accordance with section 8(2) of the 2004 Act, that the further special powers conferred on traffic officers( 3 ) by this Order are necessary for the purpose of facilitating the performance of any duties which may be assigned to them.

The Secretary of State has consulted with such representative organisations as appear appropriate in accordance with section 90E(2) of the 1988 Act.

A draft of this Order has been laid before, and approved by a resolution of, each House of Parliament in accordance with section 90E(4) of the 1988 Act and section 8(4) of the 2004 Act.

Citation, commencement and extent

1. This Order—

(a) may be cited as the Heavy Commercial Vehicles in Kent (No. 1) (Amendment) Order 2020;

(b) comes into force on 30th November 2020 or the day after the day on which it is made, whichever is later; and

(c) extends to England and Wales and Scotland, except for article 2 which extends to England and Wales only.

Amendment of the Heavy Commercial Vehicles in Kent (No. 1) Order 2019

2. —(1) The Heavy Commercial Vehicles in Kent (No. 1) Order 2019( 4 ) is amended as follows.

(2) In article 2(9) (conferral of further special powers on traffic officers) for “31st December 2020” substitute “31st October 2021”.

Amendment of the Road Safety (Financial Penalty Deposit) (Appropriate Amount) Order 2009

3. —(1) The Road Safety (Financial Penalty Deposit) (Appropriate Amount) Order 2009( 5 ) is amended as follows.

(2) In Schedule 2 (deposits for graduated fixed penalty offences)

(a) in table 7 in column (1), before “2(1)”, insert “1A(2), ”;

(b) in table 8 in column (1), before “3(1)”, insert “3(A1), ”.
