The Private Security Industry (Licence Fees) Order 2020

The Secretary of State, in exercise of the powers conferred by section 102(4) of the Finance (No. 2) Act 1987( 1 ), makes the following Order.

In accordance with section 102(5) of that Act a draft of this instrument was laid before, and approved by a resolution of, the House of Commons.

Citation, commencement and interpretation

1. β€”(1) This Order may be cited as the Private Security Industry (Licence Fees) Order 2020 and comes into force on 1st April 2020.

(2) In this Order, β€œthe 2001 Act” means the Private Security Industry Act 2001( 2 ).

Matter to be taken into account when prescribing a fee to be paid on application for a licence under section 8 of the Private Security Industry Act 2001

2. β€”(1) On the exercise by the Secretary of State of the power to prescribe a fee under section 8(7)( 3 ) of the 2001 Act, the matter referred to in paragraph (2) is to be taken into account in determining the costs of the functions referred to in paragraph (3).

(2) The matter is the recovery of any deficit incurred in relation to the functions mentioned in paragraph (3).

(3) The functions are the functions of the Security Industry Authority relating to licences to engage in licensable conduct under section 1(2)(a) and section 8 of the 2001 Act.
