The National Lottery (Revocation and Amendment) Regulations 2021

The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 12(1) and 60(4) of the National Lottery etc. Act 1993( 1 ).
Citation and commencement
1. —(1) These Regulations may be cited as the National Lottery (Revocation and Amendment) Regulations 2021.
(2) Save as provided in paragraph (3), these Regulations come into force on 30th September 2021.
(3) Regulation 3 comes into force on 1st October 2021.
Revocation of the National Lottery (Amendment) Regulations 2020
2.The National Lottery (Amendment) Regulations 2020( 2 ) are revoked.
Amendment of the National Lottery Regulations 1994
3. —(1)The National Lottery Regulations 1994( 3 ) are amended as follows.
(2) For regulation 3 substitute—
“ Age restrictions on sales of National Lottery tickets
3. —(1) No National Lottery ticket shall be sold—
(a) to a person who has not attained the age of 18 years; or
(b) by a person who has not attained the age of 18 years.
(2) Paragraph (1)(b) does not apply where a person has attained the age of 16 years and—
(a) is authorised to sell National Lottery tickets by an authorising person; or
(b) the sale has been specifically approved by a responsible person.
(3) An authorisation made under paragraph (2)(a) must—
(a) be in writing;
(b) be signed by the authorising person and the person aged 16 or 17 who is to be authorised to sell National Lottery tickets (“staff member”); and
(c) contain the information in paragraph (4).
(4) The information is—
(a) the name and date of birth of the staff member;
(b) the name and address of the premises at which the National Lottery tickets are sold;
(c) the name of the authorising person; and
(d) a statement that the staff member is authorised by the authorising person to sell National Lottery tickets.
(5) In this regulation—
“authorising person” means a person who has attained the age of 18 years and has management or control of the premises on which the staff member is authorised under paragraph (2)(a) to sell National Lottery tickets;
“responsible person” means a person who has attained the age of 18 years and—
has management or control of the premises on which the sale is made; or
works for or on behalf of the employer of the person who made the sale, at the premises on which the sale was made. ” .
(3) In regulation 6(2) for “16” substitute “18”.
