Coming into force in accordance with regulation 1

The Secretary of State makes these Regulations in exercise of the powers conferred by regulations 3(1)(a) and 5(1) of the Hazardous Substances and Packaging (Legislative Functions and Amendment) (EU Exit) Regulations 2020 (“the Regulations”)( 1 ).

The requirements in regulations 3(2) and (3) (purpose for amending and review of list of restricted substances) and 8(1) (consultation) of the Regulations have been satisfied.

By virtue of regulations 9 and 10(8) of the Regulations, the Secretary of State has treated the requirements in regulation 5(2) to (5) of the Regulations as satisfied.

Citation, commencement and extent

1. —(1) These Regulations may be cited as the Restriction of the Use of Certain Hazardous Substances in Electrical and Electronic Equipment (Amendment) (No. 2) Regulations 2021.

(2) These Regulations come into force on 1st January 2022, except as provided in paragraph (3).

(3) Regulation 2(2) comes into force on 1st July 2022.

(4) These Regulations extend to England and Wales and Scotland.

Amendment of the Restriction of the Use of Certain Hazardous Substances in Electrical and Electronic Equipment Regulations 2012

2. —(1) The Restriction of the Use of Certain Hazardous Substances in Electrical and Electronic Equipment Regulations 2012( 2 ) are amended as follows.

(2) In Schedule A1, omit sub-paragraphs (a) and (b);

(3) In Schedule A2, in Table 1—

(a) in entry No. 93, in column 6 (expiry date or status), for the words “transitional case” substitute “30th June 2026” ;

(b) after entry No. 95, insert—

Lead diazide, lead styphnate, lead dipicramate, orange lead (lead tetroxide), lead dioxide in electric and electronic initiators of explosives for civil (professional) use and barium chromate in long time pyrotechnic delay charges of electric initiators of explosives for civil (professional) use
