The School Admissions Code (Appointed Day) (England) Order 2021

The Secretary of State, in exercise of the powers conferred by sections 85(5) and 138(7) of the School Standards and Framework Act 1998( 1 ), makes the following Order.
Citation, extent and application
1. —(1) This Order may be cited as the School Admissions Code (Appointed Day) (England) Order 2021.
(2) This Order extends to England and Wales.
(3) This Order applies in relation to England only.
Appointed day
2. The day appointed for the coming into force of the School Admissions Code (a copy of a draft of which was laid before each House of Parliament on 13th May 2021)( 2 ) is 1st September 2021.
Savings provision
3. —(1) Despite article 2, the School Admissions Code 2014( 3 ) continues to have effect, as it had effect immediately before 1st September 2021, in relation to an application for the admission of a child to a maintained school made before 1st September 2021.
(2) In this article “School Admissions Code 2014” means the School Admissions Code, a copy of a draft of which was laid before each House of Parliament on 30th October 2014 and which came into force on 19th December 2014.

Section 138 was amended by paragraph 1 of Schedule 22 to the Education Act 2002 (c. 32) , paragraph 8 of Schedule 16 to the Education Act 2005 (c. 18) , paragraph 21 of Schedule 4 to and paragraph 3 of Schedule 17 to the Education and Inspections Act 2006, section 62 of the Education Act 2011 (c. 21) , and paragraph 2 of Schedule 16 to the Deregulation Act 2015 (c. 20) .
