The Pension Schemes Act 2021 (Commencement No. 7 and Transitory Provision) Regulations 2022

The Secretary of State for Work and Pensions, in exercise of the powers conferred by section 131(1), (4) and (5) of the Pension Schemes Act 2021( 1 ), makes the following Regulations.

Citation, interpretation and extent

1. —(1) These Regulations may be cited as the Pension Schemes Act 2021 (Commencement No. 7 and Transitory Provision) Regulations 2022.

(2) In these Regulations—

the Act ” means the Pension Schemes Act 2021 ;

the 2018 Act ” means the Financial Guidance and Claims Act 2018 ( 2 ).

(3) Subject to paragraph (4), these Regulations extend to England and Wales and Scotland.

(4) An amendment or repeal brought into force by regulation 2 has the same extent as the provision it amends or repeals.

Commencement

2. The day appointed for the coming into force of the following provisions of the Act, in so far as they are not already in force( 3 ), is the day after the day these Regulations are made—

(a) section 118 (qualifying pensions dashboard service);

(b) section 119 (information from occupational pension schemes);

(c) section 121 (information from personal and stakeholder pension schemes); and

(d) section 122 (the Money and Pensions Service: the pensions guidance function) so far as it inserts section 4A(2) to (6) into the 2018 Act.

Transitory modification in respect of the commencement of section 122 of the Pension Schemes Act 2021 (the Money and Pensions Service: the pensions guidance function)

3. Until section 122 of the Act comes fully into force, subsections (4) and (5) of section 4A of the 2018 Act (specific functions included in the pensions guidance function) is to be read as if—

(a) in subsection (4), the reference to “ subsections (1) to (3) ” is a reference to “subsections (2) and (3)”; and

(b) in subsection (5), the reference to “ subsections (1) to (4) ” is a reference to “subsections (2) to (4)”.
