The Secretary of State for Education makes these Regulations in exercise of the powers conferred by sections 39(1)(b), 44(1) and 104(2) of the Childcare Act 2006( 1 ) (“ the 2006 Act ”).
In accordance with section 43(2) of the 2006 Act, the Secretary of State has consulted His Majesty’s Chief Inspector of Education, Children’s Services and Skills.
Citation and commencement
1. These Regulations—
(a) may be cited as the Early Years Foundation Stage (Welfare Requirements) (England) (Amendment) Regulations 2022, and
(b) come into force on 1st December 2022.
Extent and application
2. These Regulations—
(a) extend to England and Wales, and
(b) apply in relation to England.
Amendment of the Early Years Foundation Stage (Welfare Requirements) Regulations 2012
3.The Early Years Foundation Stage (Welfare Requirements) Regulations 2012( 2 ) are amended in accordance with regulation 4 .
Amendment to regulation 3 (specification of the welfare requirements)
4. In regulation 3(2A), for “paragraphs 3.16, 3.17, 3.18, 3.52, 3.53, 3.77 and 3.78” substitute “paragraphs 3.16, 3.17, 3.18, 3.53, 3.54, 3.78 and 3.79” .
