The Secretary of State, in exercise of the powers conferred by sections 15(1) and (2), and 82(3)(a) of, and paragraphs 1(4) and 2(1) of Schedule 3 to, the Health and Safety at Work etc. Act 1974( 1 ), following consultation with the Health and Safety Executive, the Office for Nuclear Regulation and such other bodies as appeared to the Secretary of State to be appropriate in accordance with section 50(1AA)( 2 ) of that Act, makes the following Regulations.
Citation, commencement and extent
1. —(1) These Regulations may be cited as the Ammonium Nitrate Materials (High Nitrogen Content) Safety (Amendment) (No. 2) Regulations 2022 and come into force on 31st December 2022.
(2) These Regulations extend to England and Wales and Scotland.
Amendment of the Ammonium Nitrate Materials (High Nitrogen Content) Safety Regulations 2003
2. —(1)The Ammonium Nitrate Materials (High Nitrogen Content) Safety Regulations 2003( 3 ) are amended as follows.
(2) In paragraph (1) of regulation 13, for “two” substitute “seven” .

1974 c. 37 . Section 15(1) was substituted by paragraph 6 of Schedule 15 to the Employment Protection Act 1975 (c. 71) and amended by S.I. 2002/794 . Section 15(2) was amended by paragraph 5(3) of Schedule 12 to the Energy Act 2013 (c. 32) .
Subsection (1AA) was inserted by S.I. 2008/960 and amended by paragraph 11(2) of Schedule 12 to the Energy Act 2013.
S.I. 2003/1082 , amended by S.I. 2019/601 (itself amended by S.I. 2020/998 ) and S.I. 2022/29 ; there are other amending instruments but none are relevant.
