The Public Contracts (Amendment) Regulations 2022

The Minister for the Cabinet Office makes these Regulations in exercise of the powers conferred by sections 39(1), (2), (3) and (4) and 161(2) of the Small Business, Enterprise and Employment Act 2015( 1 ).
In accordance with section 39(6) of the Small Business, Enterprise and Employment Act 2015, the Minister for the Cabinet Office has undertaken such consultation as the Minister considers appropriate.
Citation, commencement and extent
1. —(1) These Regulations may be cited as the Public Contracts (Amendment) Regulations 2022 and come into force on the day after the day they are made.
(2) The amendments made by these Regulations have the same extent as the provisions to which they relate.
Amendments to the Public Contracts Regulations 2015
2. —(1)The Public Contracts Regulations 2015( 2 ) are amended as follows.
(2) In regulation 109 (Scope of Chapter 8)—
(a) in sub-paragraph (2)(b), for “£10,000” substitute “£12,000” ;
(b) in sub-paragraph (2)(c)(i), after “NHS Trust,” insert “or an NHS Foundation Trust” ;
(c) in sub-paragraph 2(c)(ii), for “£25,000” substitute “£30,000” .

2015 c. 26 . Section 39 was amended by paragraph 108 of Schedule 6 to the Wales Act 2017. See also the elaboration of “the exercise of functions relating to procurement” in section 39(2) and the definition of “contracting authority” in sections 39(3) and (4).
