The Jobseeker’s Allowance (Schemes for Assisting Persons to Obtain Employment) (Amendment) Regulations 2022

The Secretary of State for Work and Pensions makes the following Regulations in exercise of the powers conferred by sections 17A(1) and (2), 35(1) and 36(2) and (4) of the Jobseekers Act 1995( 1 ).

In accordance with section 173(1)(b) of the Social Security Administration Act 1992( 2 ), the Secretary of State has obtained the agreement of the Social Security Advisory Committee that the proposals in respect of these Regulations should not be referred to it.

Citation, Commencement and Extent

1. —(1) These Regulations may be cited as the Jobseeker’s Allowance (Schemes for Assisting Persons to Obtain Employment) (Amendment) Regulations 2022 and come into force on 14th March 2022.

(2) These Regulations extend to England and Wales and Scotland.

Amendments of the Jobseeker’s Allowance (Schemes for Assisting Persons to Obtain Employment) Regulations 2013

2. —(1)The Jobseeker’s Allowance (Schemes for Assisting Persons to Obtain Employment) Regulations 2013( 3 ) are amended as follows.

(2) In regulation 3 (schemes for assisting persons to obtain employment)

(a) omit paragraph (8);

(b) after paragraph (8C) insert—

(8D) The Restart Scheme is a scheme which provides support for a period of up to 12 months for claimants who have been unemployed for 9 months or more and reside in England and Wales.

1995 c. 18 . Section 35, as amended by S.I. 1999/527 , is an interpretation provision and is cited because of the meaning given to “prescribed” and “regulations”. Section 17A was inserted by section 1 of the Welfare Reform Act 2009 (c. 24) . Part 4 of Schedule 14 to the Welfare Reform Act 2012 (c. 5) repeals Section 17A. 17A remains in force for the purpose of making these Regulations in relation to claimants who continue to be entitled to Jobseeker’s Allowance.
