The Care and Support (Charging and Assessment of Resources) (Amendment) Regulations 2022

The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 14(7), 17(7), (11) and (12) and 125(7) of the Care Act 2014( 1 ).

Citation, commencement and extent

1. β€”(1) These Regulations may be cited as the Care and Support (Charging and Assessment of Resources) (Amendment) Regulations 2022.

(2) These Regulations come into force on 6th April 2022.

(3) These Regulations extend to England and Wales.

Amendments to the Care and Support (Charging and Assessment of Resources) Regulations 2014

2. β€”(1)The Care and Support (Charging and Assessment of Resources) Regulations 2014( 2 ) are amended as follows.

(2) In regulation 6 (personal expenses allowance for residents or temporary residents provided with accommodation in a care home), for β€œΒ£24.90” substitute β€œΒ£25.65” .

(3) In regulation 7 (minimum income guaranteed amount for other adults and carers whose needs are being met otherwise than by the provision of accommodation in a care home)β€”

(a) in paragraph (1)(b) for β€œΒ£83.65” substitute β€œΒ£86.20” ;

(b) in paragraph (2)β€”

(i) in sub-paragraph (a) for β€œΒ£72.40” substitute β€œΒ£74.60” ;

(5) In Schedule 2 (capital to be disregarded), after paragraph 39( 3 ) insertβ€”

β€œ 40. Any redress payment made to the adult under Part 4 of the Redress for Survivors (Historical Child Abuse in Care) (Scotland) Act 2021(Financial Redress: Redress Payments). ” ( 4 )
