TELECOMMUNICATIONS

The Product Security and Telecommunications Infrastructure Act 2022 (Commencement No. 1) Regulations 2023

The Secretary of State makes these Regulations in exercise of the power conferred by section 79(2) of the Product Security and Telecommunications Infrastructure Act 2022( 1 ).

Citation and interpretation

1. —(1) These Regulations may be cited as the Product Security and Telecommunications Infrastructure Act 2022 (Commencement No. 1) Regulations 2023.

(2) In these Regulations “ the Act ” means the Product Security and Telecommunications Infrastructure Act 2022.

Provisions coming into force on 7th February 2023

2. The following provisions of the Act come into force on 7th February 2023—

(a) section 57 (rights under the electronic communications code to share apparatus);

(b) section 60 (power to fly lines from apparatus kept by another operator);

(c) section 75 (meaning of “ the electronic communications code ”).

Provisions coming into force on 17th April 2023

3. The following provisions of the Act come into force on 17th April 2023—

(a) section 58 (upgrading and sharing of apparatus: subsisting agreements);

(b) section 59 (upgrading and sharing of apparatus installed before 29 December 2003).
