The Judicial Review and Courts Act 2022 (Commencement No. 4) Regulations 2023

The Lord Chancellor, in exercise of the powers conferred by section 51(4), (5) and (6) of the Judicial Review and Courts Act 2022( 1 ), makes the following Regulations:
Citation, interpretation and extent
1. β(1) These Regulations may be cited as the Judicial Review and Courts Act 2022 (Commencement No. 4) Regulations 2023.
(2) In these Regulations, β the Act β means the Judicial Review and Courts Act 2022.
(3) Subject to paragraph (4), these Regulations extend to England and Wales, and Scotland.
(4) Regulations 2(a) and (e) extend to England and Wales only.
Commencement
2. The following provisions of the Act come into force on the day after the day on which these Regulations are madeβ
(a) section 3 (automatic online conviction and penalty for certain summary offences);
(b) section 35 (composition of tribunals);
(c) section 36 (saving for existing procedural provisions);
(d) section 38 (responsibility for remunerating tribunal members);
(e) paragraphs 1 to 4 of Schedule 2 (amendments in connection with section 3);
(f) paragraphs 2 (introduction), 3 (employment tribunals β practice directions), 18 (Employment Appeal Tribunal β practice directions), 25 (general) and 29 (Tribunals, Courts and Enforcement Act 2007) of Schedule 5 (employment tribunal procedure rules: further provision).
Transitional and saving provision
3. Until such time as provision has been made for the composition of employment tribunals and the Employment Appeal Tribunal pursuant to regulations made under sections 4 and 28 of the Employment Tribunals Act 1996( 2 ), the employment tribunals and the Employment Appeal Tribunal continue to be constituted as though section 35 of the Act had not come into force.
