The Short Selling (Notification Threshold) Regulations 2023

The Treasury, in exercise of the power conferred by Article 5(4) of of the European Parliament and of the Council of 14 March 2012 on short selling and certain aspects of credit default swaps( Regulation (EU) No 236/2012 1 ), make the following Regulations.

Citation, commencement and extent

1. —(1) These Regulations may be cited as the Short Selling (Notification Threshold) Regulations 2023.

(2) These Regulations come into force on 5th February 2024.

(3) These Regulations extend to England and Wales, Scotland and Northern Ireland.

Amendment of Article 5(2) of Regulation (EU) No 236/2012

2. In Article 5(2) of of the European Parliament and of the Council of Regulation (EU) No 236/2012 14 March 2012 on short selling and certain aspects of credit default swaps( 2 ) for “0,1%”, in the first place it occurs, substitute “0,2%” .
