The Secretary of State makes these Regulations in exercise of the powers conferred by sections 551 and 569(4) of the Education Act 1996( 1 ).

Citation, commencement and extent

1. —(1) These Regulations may be cited as the Education (School Day and School Year) (England) (Amendment) Regulations 2023.

(2) These Regulations come into force on 15th March 2023.

(3) These Regulations extend to England and Wales.

Amendment of the Education (School Day and School Year) (England) Regulations 1999

2. In the Education (School Day and School Year) (England) Regulations 1999( 2 ), in regulation 3, after paragraph (7) insert—

(8) In relation to the 2022-2023 school year, the reference in paragraph (2) to 380 sessions is to be taken as a reference to 376 sessions. .

1996 c. 56 . For the definition of “regulations” see section 579(1) of that Act. Section 551(1A) was inserted by paragraph 39 of Schedule 7 to the Education Act 1997 (c. 44) . Section 551(2) was amended by paragraph 166 of Schedule 30 to, and by Schedule 31 to, the School Standards and Framework Act 1998 (c. 31) and by S.I. 2010/1158 . There are amendments to section 569 that are not relevant.
