The Secretary of State makes these Regulations in exercise of the powers conferred by sections 17(7), (11) and (12) and 125(7) of the Care Act 2014( 1 ).

Citation, commencement and extent

1. β€”(1) These Regulations may be cited as the Care and Support (Charging and Assessment of Resources) (Amendment) (No. 2) Regulations 2023 and come into force on 24th April 2023.

(2) These Regulations extend to England and Wales.

Amendment of the Care and Support (Charging and Assessment of Resources) Regulations 2014

2. In Schedule 2 to the Care and Support (Charging and Assessment of Resources) Regulations 2014( 2 ) (capital to be disregarded), after paragraph 42( 3 ) insertβ€”

β€œ 43. Any payment made to the adult which would be disregarded under section 8 of the Social Security (Additional Payments) Act 2023 (payments to be disregarded for the purposes of tax and social security) ( 4 ) . ” .
