Coming into force in accordance with article 1

The Secretary of State for Transport makes this Instrument in exercise of the powers conferred by sections 16(3), (5)(a), (6)(b), 17(1) and (2) and 19(1) of the Highways Act 1980( 1 ), and now vested in him( 2 ).

In accordance with section 16(8) of that Act, the Secretary of State has taken into consideration the requirements of local and national planning, including the requirements of agriculture, and is satisfied as to expediency.

1. This Instrument may be cited as the M180 South Humberside Motorway (Beltoft-Scunthorpe Section) and Connecting Roads (Variation) Scheme 2022 Confirmation Instrument 2023 and shall come into force on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.

2. The M180 South Humberside Motorway (Beltoft-Scunthorpe Section) and Connecting Roads (Variation) Scheme 2022 (“ the Scheme ”) is hereby confirmed with modifications.

3. The Scheme as confirmed is set out in the Schedule hereto and copies of the Scheme with its accompanying plan are deposited at the offices of the Department for Transport, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex, TN37 7GA and at the offices of National Highways Limited, Lateral, 8 City Walk, Leeds LA11 9AT.

Article 3

SCHEDULE HIGHWAYS ACT 1980

THE M180 SOUTH HUMBERSIDE MOTORWAY (BELTOFT-SCUNTHORPE SECTION) AND CONNECTING ROADS (VARIATION) SCHEME 2022

National Highways Limited( 3 ) is a company appointed( 4 ) for the time being under Part 1 of the Infrastructure Act 2015( 5 ) and is the highway authority for the special roads the provision of which is authorised by this Scheme( 6 ).

National Highways Limited make this Scheme in exercise of the powers conferred by sections 16(3), (5)(a), (6)(b), 17(1) and (2) and 19(1) of the Highways Act 1980( 7 ).

1. This Scheme may be cited at “The M180 South Humberside Motorway (Beltoft-Scunthorpe Section) and Connecting Roads (Variation) Scheme 2022” and becomes operative on the date on which the Secretary of State for Transport publishes a notice in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980 stating that this Scheme has been confirmed.

2. —(1) The M180 South Humberside Motorway (Beltoft-Scunthorpe Section) and Connecting Roads Scheme 1975( 8 ) is varied in accordance with this article.

(2) At the end of article 2 add “and the further plan” .

(3) At the end of article 3 add “save for those special roads comprising all or part of the roundabouts which shall become trunk roads on the date on which the M180 South Humberside Motorway (Beltoft-Scunthorpe Section) and Connecting Roads (Variation) Scheme 2022 becomes operative” .

(4) In article 5, after the definition of “the deposited plan” insert—

the further plan ” means the plan numbered HE/16/OD/002, marked “The M180 South Humberside Motorway (Beltoft-Scunthorpe Section) and Connecting Roads Scheme 1975 Further Plan” which is signed on behalf of, and bears the common seal of, National Highways England Limited and is deposited at National Highways Records Management, Lateral, 8 City Walk, Leeds, LS11 9AT;

the roundabouts ” means the roundabouts referred to in Schedule 2 at the junctions with Burringham Road and Brumby Common Lane respectively;

(5) In Schedule 2 (Route of the Brumby Common Link), for “a proposed roundabout on the Sheffield-Grimsby Trunk Road (A18) 1000 metres (1,094 yards) west of its junction with Scotter Road (marked D on the deposited plan)” substitute “about 2690 metres south of the A18 where the route divides at a proposed roundabout at the junction with Burringham Road (marked E on the further plan) and then continuing to about 1428 metres south of the A18 where the route divides at a new roundabout at the junction with Brumby Common Lane (marked F on the further plan) and thereafter continuing” .
