The Police, Crime, Sentencing and Courts Act 2022 (Youth Rehabilitation Order With Intensive Supervision and Surveillance) Piloting Regulations 2023

The Secretary of State makes these Regulations in exercise of the powers conferred by sections 161(3), 208(1) and (2) of the Police, Crime, Sentencing and Courts Act 2022( 1 ).

Citation, extent and interpretation I1

1. β€”(1) These Regulations may be cited as the Police, Crime, Sentencing and Courts Act 2022 (Youth Rehabilitation Order With Intensive Supervision and Surveillance) Piloting Regulations 2023.

(2) These Regulations extend to England and Wales.

(3) In these Regulationsβ€”

(a) β€œ the Act ” means the Police, Crime, Sentencing and Courts Act 2022;

(b) β€œ electronic whereabouts monitoring requirement ” has the same meaning as paragraph 45 of Schedule 6 to the Sentencing Act 2020.

Coming into force of Parts 2 and 3 of Schedule 17 to the Act I2

2. Other than paragraphs 4 and 6(4), Parts 2 and 3 of Schedule 17 to the Act come into force on 3rd July 2023.

Areas in relation to which Parts 2 and 3 of Schedule 17 to the Act are in force I3

3. Subject to regulation 4, Parts 2 and 3 of Schedule 17 come into force for courts sentencing children where the responsible officer for the order is a member of a Youth Offending Team for a borough, local authority, or unitary authority listed in the Schedule.

Period for which Parts 2 and 3 of Schedule 17 to the Act are in force I4

4. β€”(1) Subject to paragraph (2), Parts 2 and 3 of Schedule 17 to the Act, in so far as they are brought into force by regulation 2, cease to have effect at the end of 3rd January [F1 2026 F1] .

(2) Paragraph (1) does not affect the continued application after that date of an electronic whereabouts monitoring requirement imposed by a court before the date mentioned in that paragraph.
