The Proceeds of Crime Act 2002 and Terrorism Act 2000 (Certain Information Orders: Code of Practice) Regulations 2024

The Secretary of State makes these Regulations in exercise of the powers conferred by section 339ZL(5) of the Proceeds of Crime Act 2002 (“ the 2002 Act ”)( 1 ) and by section 22F(5) of the Terrorism Act 2000 (“ the 2000 Act ”)( 2 ).

In accordance with section 459(4)(azab) and (6ZBB) of the 2002 Act( 3 ) and section 123(4)(aza) of the 2000 Act( 4 ) a draft of this instrument has been laid before and approved by a resolution of each House of Parliament.

The Secretary of State has—

(a)

under section 339ZL(1) and (9) of the 2002 Act and section 22F(1) and (9) of the 2000 Act made a code of practice;

(b)

in accordance with section 339ZL(2), (3) and (4) of the 2002 Act and section 22F(2), (3) and (4) of the 2000 Act, published a draft of the code of practice, considered any representations made about the draft, modified the draft as the Secretary of State thought appropriate in the light of any such representations and laid the draft before Parliament.

Citation, commencement and extent

1. —(1) These Regulations may be cited as the Proceeds of Crime Act 2002 and Terrorism Act 2000 (Certain Information Orders: Code of Practice) Regulations 2024 and come into force on 26th April 2024.

(2) These Regulations extend to the United Kingdom.

New code of practice

2. The code of practice entitled “Code of Practice issued under section 339ZL of the Proceeds of Crime Act 2002 and section 22F of the Terrorism Act 2000 about certain information orders” and laid before Parliament in draft on 22nd January 2024 comes into operation on 26th April 2024.
