Coming into force in accordance with article 1(1)
The Lord Chancellor makes this Order in exercise of the powers conferred by sections 9(2), 41(1)(a) and (b), and 41(2)(a) and (b) of the Legal Aid, Sentencing and Punishment of Offenders Act 2012( 1 ).
A draft of this instrument has been laid before, and approved by a resolution of, each House of Parliament in accordance with section 41(6) of the Legal Aid, Sentencing and Punishment of Offenders Act 2012.
Citation, commencement and extent
1. —(1) This Order may be cited as the Legal Aid, Sentencing and Punishment of Offenders Act 2012 (Legal Aid: Domestic Abuse) (Amendment) Order 2024 and comes into force on the day after the day on which it is made.
(2) This Order extends to England and Wales only.
Amendments to Part 3 of Schedule 1 to the Legal Aid, Sentencing and Punishment of Offenders Act 2012
2. —(1) Part 3 of Schedule 1 to the Legal Aid, Sentencing and Punishment of Offenders Act 2012 (civil legal services; advocacy: exclusion and exceptions) is amended as follows.
(2) In paragraph 6—
(a) omit “and” at the end of sub-paragraph (d);
(b) at the end of sub-paragraph (e) insert—
“ , and
(f) proceedings on an appeal under section 46(1) or (5) of the Domestic Abuse Act 2021 ( 2 ) ” .
(3) In paragraph 7(b), before “and” insert—
“ (ba) paragraph 11(1A)(a) ( 3 ) and, in so far as it relates to a domestic abuse protection order made under section 28 of the Domestic Abuse Act 2021, paragraph 11(1A)(c), ”
