The Secretary of State makes this Order in exercise of the powers conferred by paragraphs 8(1), 9(1) and 10(1) of Part 2 of Schedule 8 and paragraph 3(1) of Schedule 10 to the Traffic Management Act 2004(1)(“the Act”).
East Sussex County Council has applied to the Secretary of State for an order to be made in exercise of the powers in paragraph 8(1) of Part 2 of Schedule 8 and paragraph 3(1) of Schedule 10 to the Act in respect of parts of its area.
Brighton and Hove City Council, the Borough Council of Calderdale, Cornwall Council, Dorset Council(2), Kirklees Borough Council, Knowsley Metropolitan Borough Council, Milton Keynes City Council and Slough Borough Council have each applied to the Secretary of State for an order to be made in exercise of the powers in paragraph 10(1) of Part 2 of Schedule 8 to the Act in respect of parts of their respective areas.
Pursuant to paragraphs 8(3) and 10(4) of Part 2 of Schedule 8 and paragraph 3(4) of Schedule 10 to the Act, the Secretary of State has consulted the chief officers of the Sussex Police, West Yorkshire Police, Devon and Cornwall Police, Dorset Police, Merseyside Police and Thames Valley Police.
Citation, commencement and extent
1.—(1) This Order may be cited as the Civil Enforcement of Parking Contraventions (County of East Sussex) (Amendment), Bus Lane Contraventions (Approved Local Authorities) (Amendment) and Moving Traffic Contraventions Designation Order 2025 and comes into force on 9th December 2025.
(2) This Order extends to England and Wales.
Interpretation
2. In this Order “ relevant date ” means the date on which this Order is made.
Amendment of the Road Traffic (Permitted Parking Area and Special Parking Area) (County of East Sussex) (Borough of Hastings) Order 1999
3.—(1) The Road Traffic (Permitted Parking Area and Special Parking Area) (County of East Sussex) (Borough of Hastings) Order 1999(3) is amended as follows.
(2) In article 3 (application)—
(a)omit “excluding that length of the A21 trunk road situated between the Hastings Borough boundary and the southern side of the junction with Junction Road”;
(b)insert “the whole of” before “the Borough of Hastings”.
Amendment of the Road Traffic (Permitted Parking Area and Special Parking Area) (County of East Sussex) (District of Lewes) Order 2004
4.—(1) The Road Traffic (Permitted Parking Area and Special Parking Area) (County of East Sussex) (District of Lewes) Order 2004(4) is amended as follows.
(2) In article 3 (application), omit the words from “except—” to the end of that article.
Amendment of the Bus Lane Contraventions (Approved Local Authorities) (England) Order 2005
5.—(1) The Bus Lane Contraventions (Approved Local Authorities) (England) Order 2005(5) is amended as follows.
(2) In the table in Schedule 2, after the row relating to the City of Bradford Metropolitan District Council, insert—

Designation of civil enforcement areas for moving traffic contraventions
6. The Secretary of State designates each of the following areas as a civil enforcement area for moving traffic contraventions—
(a)the part of the area of Brighton and Hove City Council designated as a permitted parking area and as a special parking area by the Road Traffic (Permitted Parking Area and Special Parking Area) (City of Brighton and Hove) Order 2001(6) as it had effect immediately before the relevant date;
(b)the part of the area of the Borough Council of Calderdale designated as a permitted parking area and as a special parking area by the Road Traffic (Permitted Parking Area and Special Parking Area) (Metropolitan Borough of Calderdale) Order 2006(7) as it had effect immediately before the relevant date;
(c)the whole of the area of Cornwall Council designated as a civil enforcement area and as a special enforcement area by the Civil Enforcement of Parking Contraventions Designation Order 2010(8) as it had effect immediately before the relevant date;
(d)the parts of the area of Dorset Council—
(i)designated as a permitted parking area and as a special parking area by the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Dorset) (Borough of Christchurch) Order 2003(9), the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Dorset) (Borough of Weymouth and Portland) Order 2002(10), the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Dorset) (District of North Dorset) Order 2002(11) and the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Dorset) (District of Purbeck) Order 2002(12) as they had effect immediately before the relevant date; and
(ii)designated as a civil enforcement area and as a special enforcement area by the Civil Enforcement of Parking Contraventions Designation Order 2016(13) as it had effect immediately before the relevant date;
(e)the part of the area of Kirklees Borough Council designated as a permitted parking area and as a special parking area by the Road Traffic (Permitted Parking Area and Special Parking Area) (Metropolitan Borough of Kirklees) Order 2006(14) as it had effect immediately before the relevant date;
(f)the part of the area of Knowsley Metropolitan Borough Council designated as a civil enforcement area and as a special enforcement area by the Civil Enforcement of Parking Contraventions Designation Order 2014(15) as it had effect immediately before the relevant date;
(g)the part of the area of Milton Keynes City Council designated as a permitted parking area and as a special parking area by the Road Traffic (Permitted Parking Area and Special Parking Area) (Borough of Milton Keynes) Order 2002(16) as it had effect immediately before the relevant date;
(h)the part of the area of Slough Borough Council designated as a permitted parking area and as a special parking area by the Road Traffic (Permitted Parking Area and Special Parking Area) (Borough of Slough) Order 2003(17) as it had effect immediately before the relevant date.

2004 c. 18. The Secretary of State is the “appropriate national authority” as regards England for the purposes of Part 6 of, and Schedule 8 to, the Traffic Management Act 2004 (“2004 Act”), by virtue of section 92(1) of that Act.
By the Bournemouth, Dorset and Poole (Structural Changes) Order 2018 (S.I. 2018/648) (“the 2018 Order”), the county of Dorset was abolished and its county council wound up and dissolved (article 8 of that Order). Among other things, the 2018 Order established a new non-metropolitan county and a new non-metropolitan district, to be known as Dorset, and the new Dorset Council. The areas designated by the orders referred to in article 6(d) of this Order are now (by virtue of the 2018 Order) part of the Dorset Council’s area.
S.I. 1999/1112 (“the 1999 Order”). Paragraph 8(4) of Schedule 8 to the 2004 Act provides that the 1999 Order has effect as if made under paragraph 8 of Schedule 8 to the 2004 Act.
S.I. 2004/2111 (“the 2004 Order”). Paragraph 8(4) of Schedule 8 to the 2004 Act provides that the 2004 Order has effect as if made under paragraph 8 of Schedule 8 to the 2004 Act.
S.I. 2005/2755 (“the 2005 Order”); relevant amending instruments are S.I. 2010/99, 2010/2790, 2012/846, 2012/2659, 2013/992, 2013/2594 and 2024/1135. Paragraph 9(3) of Schedule 8 to the 2004 Act provides that the 2005 Order has effect as if made under paragraph 9 of Schedule 8 to the 2004 Act.
S.I. 2002/421. Milton Keynes was awarded city status on 15 August 2022 by letters patent and is now Milton Keynes City Council.
