The Secretary of State makes these Regulations in exercise of the powers conferred by sections 39(1)(b), 43(1), 44(1) and 104(2) of the Childcare Act 2006(1).

In accordance with section 43(2) of the Childcare Act 2006, the Secretary of State has consulted His Majesty’s Chief Inspector of Education, Children’s Services and Skills and other appropriate persons.

Citation, commencement and extent

1. These Regulations

(a)may be cited as the Early Years Foundation Stage (Welfare Requirements) (Amendment) Regulations 2025,

(b)come into force on 3rd March 2025, and

(c)extend to England and Wales.

Amendment of the Early Years Foundation Stage (Welfare Requirements) Regulations 2012

2. In the Early Years Foundation Stage (Welfare Requirements) Regulations 2012(2), in regulation 3(4), for “8th December 2023” substitute “10th February 2025”(3).
