The Official Controls (Extension of Transitional Periods) (Amendment) Regulations 2025

Coming into force in accordance with regulation 1(2)
The Secretary of State makes the following Regulations in exercise of the powers conferred by Article 144(6) of, and paragraph 2 of Annex 6 to, Regulation (EU) 2017/625 of the European Parliament and of the Council on official controls and other official activities performed to ensure the application of food and feed law, rules on animal health and welfare, plant health and plant protection products (βthe Official Controls Regulationβ)(1).
In accordance with Article 144(7) of the Official Controls Regulation(2), before making these Regulations, the Secretary of State has consulted such bodies and persons as appear to the Secretary of State to be representative of the interests likely to be substantially affected by these Regulations and such other bodies or persons as the Secretary of State considers appropriate.
In accordance with Article 3(2B)(b) of the Official Controls Regulation(3), the Welsh Ministers, in relation to the application of these Regulations in relation to Wales, and the Scottish Ministers, in relation to the application of these Regulations in relation to Scotland, have consented to the making of these Regulations by the Secretary of State.
Citation, commencement and extent
1.β(1) These Regulations may be cited as the Official Controls (Extension of Transitional Periods) (Amendment) Regulations 2025.
(2) They come into force on 20th May 2025, with the exception of regulations 2 and 4, which come into force on 1st July 2025.
(3) They extend to England and Wales and Scotland.
Amendment to Regulation (EU) 2017/625
2.β(1) Regulation (EU) 2017/625 of the European Parliament and of the Council on official controls and other official activities performed to ensure the application of food and feed law, rules on animal health and welfare, plant health and plant protection products(4) is amended as follows.
(2) In Annex 6, paragraph 2 (interpretation), in the definition of βexcepted goodsβ, in point (i), for β1st July 2025β substitute β31st January 2027β.
Amendment to the Official Controls (Extension of Transitional Periods) Regulations 2021
3.β(1)The Official Controls (Extension of Transitional Periods) Regulations 2021(5) are amended as follows.
(2) In regulation 2 (end of the transitional staging period), for β1st July 2025β substitute β31st January 2027β.
Amendment to the Official Controls (Plant Health) (Frequency of Checks) Regulations 2022
4.β(1)The Official Controls (Plant Health) (Frequency of Checks) Regulations 2022(6) are amended as follows.
(2) In regulation 3(1A) (determination of the frequency rate of physical checks and identity checks)β
(a)in sub-paragraph (b), for β1st July 2025β substitute β31st January 2027β;
(b)for sub-paragraph (c) substituteβ
β(c)are imported through a relevant port; andβ.

EUR 2017/625. Annex 6 was inserted by S.I. 2020/1481 for the purposes of its application in relation to the entry of relevant goods from a relevant third country during the transitional staging period. The terms βrelevant goodsβ, βrelevant third countryβ and βthe transitional staging periodβ are defined in paragraph 2 of Annex 6, as amended by S.I. 2022/1315 and 2023/959. Annex 6 was amended by S.I. 2021/429, 809, 2022/621, 1315, 2023/959, 1131, 2024/20, 541, 557, 1001 and 2025/102. It was also amended in relation to England and Wales by S.I. 2021/1096, 1443 and in relation to Scotland by S.S.I. 2021/342, 493 and 2022/90.
Article 144(7) was substituted by S.I. 2020/1481.
Article 3(2B) was inserted by S.I. 2020/1481.
