The Secretary of State makes these Regulations in exercise of the powers conferred by section 508B(11)(1) of, and paragraph 3(6) of Schedule 35C(2) to, the Education Act 1996.

Citation, commencement and extent

1. These Regulations

(a)may be cited as the School Travel (Pupils with Dual Registration) (England) (Amendment) Regulations 2025,

(b)come into force on 30th June 2025, and

(c)extend to England and Wales.

Amendment of the School Travel (Pupils with Dual Registration) (England) Regulations 2007

2. For sub-paragraph (c) of regulation 2(4) of the School Travel (Pupils with Dual Registration) (England) Regulations 2007(3) (modification of the application of the Education Act 1996) substitute—

(c)a child has no fixed abode if they have no fixed abode for the reason that their parent is engaged in a trade or business of such nature as to require the child to travel from place to place..

Section 508B was inserted by section 77(1) of the Education and Inspections Act 2006 (c. 40) (“the 2006 Act”), and was amended by paragraphs 7(1) to (3) of Schedule 2 to the Local Education Authorities and Children’s Services Authorities (Integration of Functions) Order 2010 (S.I. 2010/1158).
