The King's Most Excellent Majesty in Council
His Majesty, by and with the advice of His Privy Council, in exercise of the powers conferred upon him by sections 159, 206(4) and 208 of the Copyright, Designs and Patents Act 1988(1) (“the Act”), is pleased to order, and it is hereby ordered, as follows.
His Majesty is satisfied that provision has been or will be made under the law of India, in respect of wireless broadcasts(2) and broadcasts(3), giving adequate protection to the owners of copyright under Part 1 of the Act and that provision has been or will be made under the law of India giving adequate protection for British performances(4).
Citation, commencement and extent
1.—(1) This Order may be cited as the Copyright and Performances (Application to Other Countries) (Amendment) Order 2026.
(2) This Order comes into force on the day on which the UK-India Comprehensive Economic and Trade Agreement enters into force for the United Kingdom and India(5).
(3) This Order extends to England and Wales, Scotland and Northern Ireland.
(4) In this article “ the UK-India Comprehensive Economic and Trade Agreement ” means the Comprehensive Economic and Trade Agreement between the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of the Republic of India, signed in Buckinghamshire on 24 July 2025( 6 ).
Amendment of the Copyright and Performances (Application to Other Countries) Order 2016
2. The Copyright and Performances (Application to Other Countries) Order 2016(7) is amended in accordance with articles 3 and 4.
Broadcasts: application of Part 1 of the Act to India
3. In (broadcasts: application of Part 1 of the Act to miscellaneous countries), in article 8 paragraphs (1) and (2) , for “and New Zealand” substitute “, New Zealand and India” .
Performances: application of Part 2 of the Act to India
4.—(1) After , insert — article 12A
Application of Part 2 of the Act to India
12B.—(1) India is, subject to paragraphs (2) and (3), designated as enjoying reciprocal protection under Part 2 of the Act.
(2) Part 2 of the Act applies to India subject to the modification set out in paragraph (3).
(3) Section 182D(8) (right to equitable remuneration for exploitation of sound recording) does not apply.”.
(2) In the Schedule, in Part 2(9) (WPPT parties and WTO members which are not Rome Convention parties: application of Part 2 of the Act), omit the entry for India.

“Broadcast” is defined in section 6 of the Copyright, Designs and Patents Act 1988.
“British performance” is defined in section 208 (3) of the Copyright, Designs and Patents Act 1988.
