The Secretary of State makes these Regulations in exercise of the powers conferred by sections 14(1) and 20(1)(b) of the Retained EU Law (Revocation and Reform) Act 2023 (“the 2023 Act”)(1).

The Secretary of State is a relevant national authority for the purpose of section 14(1) of the 2023 Act(2).

The requirements of paragraph 6(2) of Schedule 5 to the 2023 Act (relating to the appropriate Parliamentary procedure for these Regulations) have been satisfied.

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Merchant Shipping (Monitoring, Reporting and Verification of Carbon Dioxide Emissions) (Revocation) Regulations 2026.

(2) These Regulations come into force on the 22nd day after the day on which they are laid.

(3) These Regulations extend to England and Wales, Scotland and Northern Ireland.

Revocations

2. The following instruments are revoked—

(a) of the European Parliament and of the Council of 29 April 2015 on the monitoring, reporting and verification of carbon dioxide emissions from maritime transport, and amending Regulation (EU) 2015/757(Directive 2009/16/EC3);

(b)The Merchant Shipping (Monitoring, Reporting and Verification of Carbon Dioxide Emissions) and the Port State Control (Amendment) Regulations 2017(4);

(c)The Merchant Shipping (Monitoring, Reporting and Verification of Carbon Dioxide Emissions) (Amendment) (EU Exit) Regulations 2018(5);

(d)Commission Implementing of 4 November 2016 on templates for monitoring plans, emissions reports and documents of compliance pursuant to Regulation (EU) 2016/1927 of the European Parliament and of the Council on monitoring, reporting and verification of carbon dioxide emissions from maritime transport(Regulation (EU) 2015/7576);

(e)Commission Delegated of 22 September 2016 amending Regulation (EU) 2016/2071 of the European Parliament and of the Council as regards the methods for monitoring carbon dioxide emissions and the rules for monitoring other relevant information(Regulation (EU) 2015/7577).
