Coming into force in accordance with regulation 1(2)
The Secretary of State makes these Regulations in exercise of the powers conferred by sections 1(1), 2(2)(h), 2(3)(g), 2(3)(h) and 13(2)(g) of the Product Regulation and Metrology Act 2025(1).
In accordance with section 13(6) of that Act, the Secretary of State has consulted such persons as the Secretary of State considered appropriate.
Part 1 Preliminary
Citation, commencement and extent
1.—(1) These Regulations may be cited as the Treatment of Conformity Assessment Bodies (Comprehensive Economic and Trade Agreement between the Government of Great Britain and Northern Ireland and the Government of the Republic of India) Regulations 2026.
(2) These Regulations come into force immediately after the Comprehensive Economic and Trade Agreement between the Government of Great Britain and Northern Ireland and the Government of the Republic of India signed on 24 July 2025 (“ the Agreement ”) enters into force (on which see Article 30.6 of the Agreement)( 2 ).
(3) The Secretary of State must publish a notice in the London Gazette, as soon as reasonably practicable, of the date on which the Agreement enters into force.
(4) These Regulations extend to England and Wales and Scotland only.
Part 2 Amendment to subordinate legislation
Amendment of the Toys (Safety) Regulations 2011
2. Paragraph 1(1) of Schedule 7 (approved body requirements) to the Toys (Safety) Regulations 2011(3) is amended as follows—
(a)omit the “or” after sub-paragraph (a);
(b)after sub-paragraph (b) insert—
“; or
(c)the territory of the Republic of India.”.
Amendment of the Electromagnetic Compatibility Regulations 2016
3. Paragraph 1(1) of Schedule 5 (requirements for approved bodies) to the Electromagnetic Compatibility Regulations 2016(4) is amended as follows—
(a)omit the “or” after sub-paragraph (a);
(b)after sub-paragraph (b) insert—
“; or
(c)the territory of the Republic of India.”.
Amendment of the Simple Pressure Vessels (Safety) Regulations 2016
4. Paragraph 1(1) of Schedule 4 (notified bodies) to the Simple Pressure Vessels (Safety) Regulations 2016(5) is amended as follows—
(a)omit the “or” after sub-paragraph (a);
(b)after sub-paragraph (b) insert—
“; or
(c)the territory of the Republic of India.”.
Amendment of the Lifts Regulations 2016
5. Paragraph 1(1) of Schedule 4 (approved body requirements) to the Lifts Regulations 2016(6) is amended as follows—
(a)omit the “or” after sub-paragraph (a);
(b)after sub-paragraph (b) insert—
“; or
(c)the territory of the Republic of India.”.
Amendment of the Pressure Equipment (Safety) Regulations 2016
6.—(1) The Pressure Equipment (Safety) Regulations 2016(7) are amended as follows.
(2) In sub-paragraph (a) of paragraph 31(8) (materials) of Schedule 2 (essential safety requirements), after (i) insert—
“(ia)the territory of the Republic of India.”.
(3) In paragraph 2 of Schedule 4 (approved body requirements) —
(a)omit the “or” after sub-paragraph (a);
(b)after sub-paragraph (b) insert—
“; or
(c)the territory of the Republic of India.”.
Amendment of the Equipment and Protective Systems Intended for Use in Potentially Explosive Atmospheres Regulations 2016
7. Paragraph 1(1) of Schedule 2 (approved body requirements) to the Equipment and Protective Systems Intended for Use in Potentially Explosive Atmospheres Regulations 2016(8) is amended as follows—
(a)omit the “or” after sub-paragraph (a);
(b)after sub-paragraph (b) insert—
“; or
(c)the territory of the Republic of India.”.
Amendment of the Non-automatic Weighing Instruments Regulations 2016
8. Paragraph 1(1) of Schedule 3 (approved body requirements) to the Non-automatic Weighing Instruments Regulations 2016(9) is amended as follows—
(a)omit the “or” after sub-paragraph (a);
(b)after sub-paragraph (b) insert—
“; or
(c)the territory of the Republic of India.”.
Amendment of the Measuring Instruments Regulations 2016
9. Paragraph 1(1) of Schedule 5 (requirements related to approved bodies) to the Measuring Instruments Regulations 2016(10) is amended as follows—
(a)omit the “or” after sub-paragraph (a);
(b)after sub-paragraph (b) insert—
“; or
(c)the territory of the Republic of India.”.
Amendment of the Recreational Craft Regulations 2017
10. Paragraph 1(1) of Schedule 11 (requirements of approved bodies) to the Recreational Craft Regulations 2017(11) is amended as follows—
(a)omit the “or” after sub-paragraph (a);
(b)after sub-paragraph (b) insert—
“; or
(c)the territory of the Republic of India.”.
Amendment of the Radio Equipment Regulations 2017
11. Paragraph 1(1) of Schedule 8 (approved body requirements) to the Radio Equipment Regulations 2017(12) is amended as follows—
(a)omit the “or” after sub-paragraph (a);
(b)after sub-paragraph (b) insert—
“; or
(c)the territory of the Republic of India.”.
Part 3 Amendment to assimilated direct legislation
Amendment of Regulation (EU) 2016/425
12. Paragraph 2 of Article 24 (approved body requirements) of of the European Parliament and of the Council on personal protective equipment and repealing Council Directive Regulation (EU) 2016/42589/686/EEC(13) is amended as follows—
(a)omit the “or” after sub-paragraph (a);
(b)after sub-paragraph (b) insert—
“; or
(c)the territory of the Republic of India.”.
Amendment of Regulation (EU) 2016/426
13. Paragraph 2 of Article 23 (approved body requirements) of of the European Parliament and of the Council on appliances burning gaseous fuels and repealing Regulation (EU) 2016/426(Directive 2009/142/EC14) is amended as follows—
(a)omit the “or” after sub-paragraph (a);
(b)after paragraph (2) insert—
“; or
(c)the territory of the Republic of India.”.

The date on which the Comprehensive Economic and Trade Agreement between the Government of Great Britain and Northern Ireland and the Government of the Republic of India enters into force will be published in the London Gazette in accordance with regulation 1(3) and will also be available by referring to the relevant page on the UK-India Trade Deal ( https://www.gov.uk/government/collections/uk-india-trade-deal).
