The Immigration (Leave to Enter and Remain) (Amendment) Order 2026

The Secretary of State makes this Order in exercise of the powers conferred by section 3A(1), (2) and (7) of the Immigration Act 1971 (“the 1971 Act”)(1).

A draft of this Order has been laid before Parliament in accordance with section 3A(13) of the 1971 Act and approved by a resolution of each House of Parliament.

Citation, commencement and extent

1.—(1) This Order may be cited as the Immigration (Leave to Enter and Remain) (Amendment) Order 2026.

(2) This Order comes into force on 6th July 2026.

(3) This Order extends to the United Kingdom.

Amendment of the Immigration (Leave to Enter and Remain) Order 2000

2. In the Immigration (Leave to Enter and Remain) Order 2000(2), in article 8B (further provision as to automatic grant of leave), in paragraph (2), in sub-paragraph (c), for “10” substitute “8”.
