In excercise of the powers conferred on the Secretary of State by sections 19 and 42(6) and (7) of the Teaching and Higher Education Act 1998( 1 ), the Secretary of State for Education and Employment hereby makes the following Regulations.

1. These Regulations may be cited as the Education (Induction Arrangements for School Teachers) (Amendment No. 3) (England) Regulations 2001 and shall come into force on 25th May 2001.

2. The Education (Induction Arrangements for School Teachers) (England) Regulations 1999( 2 ) shall be amended as follows.

3. For regulation 5 there shall be substituted the following regulation

5. —(1) In these Regulations,“appeal body” means—

(a) in relation to an appeal against a decision of the appropriate body falling within regulation 14(3)(b) or (c), where the induction period ends on or before 30th June 2001, the Secretary of State; and

(b) in all other cases, the General Teaching Council for England ( 3 ) .

(2) In paragraph (1) “induction period” includes an induction period which has been extended following its completion in accordance with regulation 14(3)(b), regulation 17(3)(c) or regulation 17(4)(c) so that the period as extended ends on or before 30th June 2001. .

4. In paragraph 3(1)(c) of Schedule 2 for “if any” there shall be substituted “if employed in a teaching capacity”.
