The Goods Vehicles (Plating and Testing) (Amendment) Regulations 2004

The Secretary of State for Transport, in exercise of the powers conferred by sections 49 and 51(1) of the Road Traffic Act 1988( 1 ) and by virtue of the Department of Transport (Fees) Order 1988( 2 ), and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Goods Vehicles (Plating and Testing) (Amendment) Regulations 2004 and shall come into force on 30th August 2004.

Preliminary

2.The Goods Vehicles (Plating and Testing) Regulations 1988( 3 ) shall be further amended as follows.

Amendment to regulation 12 (manner of making application for first examinations or periodical tests, and fees)

3. In regulation 12(3), for the Table there shall be substituted the following Table—

Amendments to regulation 16 (fees for re-tests)

4. —(1) Regulation 16 shall be amended as follows.

(2) In paragraph (1) for “£23.50 in the case of a motor vehicle and £12.50 in the case of a trailer” there shall be substituted determined in accordance with the Table below by reference to the description of vehicle—

(3) In paragraph (3)(a) for “in which a fee was payable under that paragraph” there shall be substituted “other than those described in paragraph (6)”.

(4) In paragraph (3) for “£23.50 in the case of a motor vehicle and £12.50 in the case of a trailer” there shall be substituted “determined in accordance with the Table in paragraph (1) by reference to the description of vehicle”.

(5) In paragraph (6) for “Any fee which would otherwise be payable by virtue of paragraph (1), (3), (4) or (4A) shall not be payable” there shall be substituted “Notwithstanding paragraphs (1), (3), (4) and (4A), the fee for a re-test under regulation 15 shall be £10 in the case of a motor vehicle and £5 in the case of a trailer”.

Further amendments relating to fees

5. In the regulations specified in column (1) of the following Table for the amounts specified in column (2) there shall be substituted the amounts specified in column (3)

6. At the end of paragraph 4 of Part II of Schedule 3, there shall be added the following descriptions—
