The Misuse of Drugs Act 1971 (Amendment) Order 2005

A draft of this Order has been laid before Parliament on the recommendation of the Advisory Council on the Misuse of Drugs and has been approved by a resolution of each House of Parliament.

Accordingly, Her Majesty, in pursuance of section 2(2) of the Misuse of Drugs Act 1971( 1 ), is pleased, by and with the advice of Her Privy Council, to order, and it is ordered, as follows:—

1. This Order may be cited as the Misuse of Drugs Act 1971 (Amendment) Order 2005 and shall come into force on 1st January 2006.

2. In Part 3 of Schedule 2 to the Misuse of Drugs Act 1971 ( 2 ) (which specifies the drugs which are subject to control under that Act as Class C drugs), in paragraph 1(a) after “4-Hydroxy-n-butyric acid”( 3 ) insert “Ketamine”.

Schedule 2 has been amended by a number of statutory instruments. S.I. 2003/1243 is relevant to this Order.

The substance 4-Hydroxy-n-butyric acid was inserted into paragraph 1(a) of Part 3 to Schedule 2 to the Misuse of Drugs Act 1971 by Article 2 of S.I. 2003/1243 .
