The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 7, 10, 22 and 31 of the Misuse of Drugs Act 1971( 1 ).
In accordance with section 31(3) of that Act he has consulted with the Advisory Council on the Misuse of Drugs.
Citation and commencement
1. These Regulations may be cited as the Misuse of Drugs (Amendment) (No. 3) Regulations 2005 and shall come into force on 1st January 2006.
Amendment of the Misuse of Drugs Regulations 2001
2. In Part 1 of Schedule 4 to the Misuse of Drugs Regulations 2001( 2 ) (which specifies some of the controlled drugs that are subject to the requirements of regulations 22, 23, 26 and 27 and for which provision is made by certain other regulations), in paragraph 1 after โ4-Hydroxy-n-butyric acidโ insert โKetamineโ( 3 ).

1971 c. 38 . Section 22 of that Act was amended by section 177(1) of, and paragraph 12 of Schedule 4 to, the Customs and Excise Management Act 1979 (c. 2) .
S.I. 2001/3998 , to which there are a number of amendments. The substance 4-Hydroxy-n-butyric acid was inserted into paragraph 1 of Part 1 of Schedule 4 to the Misuse of Drugs Regulations 2001 by S.I. 2003/1432 .
The substance Ketamine was inserted into Part 3 of Schedule 2 to the Misuse of Drugs Act 1971, which specifies drugs which are subject to control under that Act as Class C drugs, by S.I. 2005/3178 .
