The Secretary of State, in exercise of the powers conferred upon him by sections 113(1)(b), 114(1)(b), 115(1)(b), 116(1)(b) and 125(1) and (5) of the Police Act 1997( 1 ),and having regard to the meaning of “prescribed” hereby makes the following Regulations:

Citation, commencement, interpretation and extent

1. —(1) These Regulations may be cited as the Police Act 1997 (Criminal Records) (Amendment) Regulations 2005.

(2) This regulation and regulation 2 shall come into force on 25th March 2005 and regulation 3 shall come into force on 1st April 2005.

(3) In these Regulations “the 2002 Regulations”( 2 ) means the Police Act 1997 (Criminal Records) Regulations 2002 .

(4) These Regulations extend to England and Wales.

Fees payable to police authorities for information provided to the Secretary of State

2. For Schedule 3 to the 2002 Regulations there shall be substituted the Schedule set out in the Schedule to these Regulations.

Fees for criminal record certificates and enhanced criminal record certificates

3. —(1) In regulation 4 of the 2002 Regulations for “£28” there shall be substituted “£29”.

(2) In regulation 4A of the 2002 Regulations for “£33” there shall be substituted “£34”.
