The Secretary of State, being a Minister designated( 1 ) for the purposes of section 2(2) of the European Communities Act 1972( 2 ) in relation to measures relating to noise emission in the environment by equipment for use outdoors, in exercise of the powers conferred on him by that section, makes the following Regulations:

Citation and commencement I1

1. These Regulations may be cited as the Noise Emission in the Environment by Equipment for Use Outdoors (Amendment) Regulations 2005 and shall come into force on 3rd January 2006.

Amendment to the Noise Emission in the Environment by Equipment for Use Outdoors Regulations 2001I2

2. The Noise Emission in the Environment by Equipment for Use Outdoors Regulations 2001( 3 ) are amended by substituting for the table in Schedule 3 the table set out in the Schedule to these Regulations.

For the following types of equipment the figures for Stage I shall continue to apply for Stage II—

  • Walk-behind vibrating rollers;

  • Vibratory plates (>3 kW);

  • Vibratory rammers;

  • Dozers (steel tracked);

  • Loaders (steel tracked >55 kW);

  • Combustion-engine driver counterbalanced lift trucks;

  • Compacting screed paver-finishers; and

  • Hand-held internal combustion-engine concrete-breakers and picks (15< m<30).

For single engine mobile cranes the figures for Stage I shall continue to apply until 3rd January 2008. After that date, Stage II figures shall apply.
