The Secretary of State for Transport is a Minister designated for the purposes of section 2(2) of the European Communities Act 1972( 1 ) for the regulation of the type, description, construction or equipment of vehicles, and of components of vehicles, and in particular any vehicle type approval scheme( 2 ).

Accordingly, in exercise of the powers conferred upon her by that section, she makes the following Regulations:

Citation, commencement and interpretation

1. —(1) These Regulations may be cited as the Motor Vehicles (EC Type Approval) (Amendment No. 2) Regulations 2007, and shall come into force on 1st December 2007.

(2) In these Regulations, “the principal Regulations” means the Motor Vehicles (EC Type Approval) Regulations 1998 ( 3 ).

Amendment of regulation 3 (interpretation)

2. In regulation 3(1) of the principal Regulations, for the definition of “the Framework Directive”, substitute—

“the Framework Directive” means Council Directive ( 70/156/ ( EEC 4 ) , dated 6th February 1970—

(a)

as last amended by Commission Directive ( 2006/96/EC 5 ) , dated 20th November 2006, and

(b)

construed as required by Article 10 of Directive 2005/55/EC of the European Parliament and of the Council, dated 28th September 2005 ( 6 ) ; .

Amendment of Schedule 1 (separate Directives)

3. —(1) The table in Schedule 1 to the principal Regulations is amended as follows.

(2) In items 1 to 3, 7 to 10, 13, 15, 16, 18, 21 to 26, 28 to 31, 35, 36, 38, 43, 50 to 52, 57 and 60, in the third and fourth columns, after the last entry in each item, add—

(3) In item 16 (external projections), in the third and fourth columns, after the last entry, add—

2007/15/EC* L75, 15.3.2007, p.21 .

(4) In item 41 (diesel emissions), in the third and fourth columns, after the last entry, add—

(5) After item 60, add the following item—
