PUBLIC PASSENGER TRANSPORT

The Public Service Vehicles (Operators’ Licences) (Fees) (Amendment) Regulations 2007

The Secretary of State for Transport makes the following Regulations in exercise of the powers conferred by sections 52(1) and 60(1)(e) and (1A) of the Public Passenger Vehicles Act 1981( 1 ) and by virtue of the Department of Transport (Fees) Order 1988( 2 ).

He has consulted with representative organisations in accordance with section 61(2) of the Public Passenger Vehicles Act 1981( 3 ).

Citation and commencement

1. These Regulations may be cited as the Public Service Vehicles (Operators’ Licences) (Fees) (Amendment) Regulations 2007 and shall come into force on 1st April 2007.

Amendments

2. The Schedule to the Public Service Vehicles (Operators’ Licences) (Fees) Regulations 1995( 4 ) (the “principal Regulations”) is amended by substituting—

(a) in relation to fee number (i), “£213” for “£202”;

(b) in relation to fee number (ii), “£141” for “£134”;

(c) in relation to fee numbers (iii) and (iv), respectively—

(i) in column 3, “£141” for “£134”; and

(ii) in column 5, “£28” for “£27” in each place where it occurs;

(d) in relation to fee number (v), “£108” for “£102”;

(e) in relation to fee number (vi)—

(i) in column 3, “£6” for “£5.75”; and

(ii) in column 5, “£7” for “£6.50”;

(f) in relation to fee numbers (vii) and (viii), respectively “£56” for “£53”; and

(g) in relation to fee number (ix), “£15” for “£14”.

Transitional provisions

3. Where a decision has been made before the coming into force of these Regulations on an application for the grant of a standard or restricted licence under section 14(1) of the Public Passenger Vehicles Act 1981( 5 ), the fee prescribed in the principal Regulations immediately before the coming into force of these Regulations applies notwithstanding that the period of 21 days within which it is payable has not expired before that date.

1981 c.14 (in these footnotes called “the 1981 Act”). Relevant amendments to section 52(1) of the 1981 Act were made by the Transport Act 1985 (c.67) (in the footnotes called “the 1985 Act”), sections 1(3), 3(5) and 139(3), and paragraph 7 of Schedule 1, paragraphs 4(1) and 4(14) of Part II of Schedule 2 and Schedule 8, and by the Deregulation and Contracting Out Act 1994 (c.40) (in the footnotes called “the 1994 Act”), section 66. In section 60: subsection (1) was amended by the 1994 Act, section 66(5); and subsection (1A) was inserted by the 1985 Act, section 134(1) and (2). For the definition of “prescribed” see section 60(2) of the 1981 Act, as amended by the 1985 Act, sections 134(1) and (2)(c).

S.I. 1988/643 , which was made under the Finance (No. 2) Act 1987 (c.51) , section 102. The relevant entry in S.I. 1988/643 is Schedule 1, Table V, Item 2.D.

By virtue of section 135 of the 1985 Act, section 61 of the 1981 Act has effect as if Part I of the 1985 Act were contained in the 1981 Act. Section 61(2) of the 1981 Act was amended by the 1985 Act, section 139(3) and Schedule 8.
