The Secretary of State for Children, Schools and Families makes the following Regulations in exercise of the powers conferred by section 50(3)(b) of the School Standards and Framework Act 1998( 1 ):

Citation, commencement and application

1. —(1) These Regulations may be cited as the School Budget Shares (Prescribed Purposes) (England) (Amendment) Regulations 2010.

(2) Subject to paragraph (3), these Regulations come into force on 1st March 2010.

(3)Regulation 2(3) comes into force on 1st April 2010.

(4) These Regulations apply only in relation to England.

Amendment of the School Budget Shares (Prescribed Purposes) (England) Regulations 2002

2. —(1)The School Budget Shares (Prescribed Purposes) (England) Regulations 2002( 2 ) are amended as follows.

(2) In regulation 3, after sub-paragraph (c) insert—

(d) (i) the provision of staff, goods, services, accommodation or other resources to a relevant person or body; or

(ii) the making of contributions to a fund out of which relevant payments may be made,

for the purposes of arrangements made under section 10 of the Children Act 2004(co-operation to improve well-being) ( 3 ) (“ CA 2004 ”), and in this sub-paragraph “relevant person or body” and “relevant payment” have the meanings given by section 10(11) of CA 2004; .

(3) In regulation 3, after sub-paragraph (d) insert—

(e) (i) the provision of staff, goods, services, accommodation or other resources ; or

(ii) the making of payments towards expenditure incurred,

by, or for purposes connected with the functions of, the Children’s Trust Board ( 4 ) for the area in which the school is situated. .
