The Crime (Sentences) Act 1997 (Commencement No. 5) Order 2012

The Secretary of State makes the following Order in exercise of the power conferred by section 57(2) of the Crime (Sentences) Act 1997( 1 ).
Citation
1. This Order may be cited as the Crime (Sentences) Act 1997 (Commencement No. 5) Order 2012.
Repeal of section 67 of the Criminal Justice Act 1967
2. The following provisions of the Crime (Sentences) Act 1997 come into force on 3rd December 2012 for remaining purposes( 2 )—
(a) section 56(2) so far as it relates to the provision mentioned in subparagraph (b); and
(b) the entry in Schedule 6 (repeals) relating to section 67 of the Criminal Justice Act 1967( 3 ) (computation of sentences of imprisonment passed in England and Wales).

Schedule 6 to the Crime (Sentences) Act 1997 makes provision for repealing (among other things) section 67 of the Criminal Justice Act 1967. The repealing provision was commenced, so far as it relates to that section, by article 2(1) and (2) of the Crime (Sentences) Act 1997 (Commencement No. 4) Order 2005 ( S.I. 2005/932 ). However, article 2(3) of that Order provides that the coming into force of the repeal is of no effect in relation to a case in which a court has imposed a sentence of imprisonment in respect of an offence committed before 4th April 2005.
