The Police (Promotion) (Amendment) Regulations 2015

The Secretary of State, in exercise of the powers conferred by section 50 of the Police Act 1996( 1 ), makes the following Regulations.

In accordance with section 50(2ZC)( 2 ) of that Act, the text of these Regulations has been approved by the College of Policing.

Citation and commencement

1. These Regulations may be cited as the Police (Promotion) (Amendment) Regulations 2015 and come into force on 1st April 2015.

Amendments to the Police (Promotion) Regulations 1996

2.The Police (Promotion) Regulations 1996( 3 ) are amended as follows.

3. In regulation 3(7), for “(1) and (2)” substitute “(1), (2), (2A) and (2B)”.

4. In regulation 5(3)—

(a) after “completing” insert “, or has completed,”;

(b) after “Part II” omit “B”.

5. In regulation 6(2), after “Part II” omit “B”.

6. In Schedule 1—

(a) in paragraph 1—

(i) in sub-paragraph (1), for “examinations board” substitute “College of Policing”;

(ii) in sub-paragraph (2)(b), for “either Part IIA, consisting of practical tests, or Part IIB”, substitute “Part II”;

(iii) in sub-paragraph (2A), after “Part II” omit “B”;

(iv) in sub-paragraph (3), for “Parts I and IIA” substitute “Part I”;

(b) for paragraph 2, substitute—

2. The College of Policing shall determine the standard to be achieved by a candidate in order to obtain a pass in any part of the qualifying assessments. ;

(c) for paragraph 3, substitute—

3. The College of Policing shall—

(a) set and mark the written paper referred to in paragraph 1(2); and

(b) set the criteria against which Part II is to be assessed. ;

(d) in paragraph 4—

(i) for “examinations board” substitute “College of Policing”;

(ii) in sub-paragraph (a), for “each Part” substitute “Part I”;

(e) in paragraph 5—

(i) omit sub-paragraph (1);

(ii) in sub-paragraph (1A), omit “in a force using the Part IIB assessment process”;

(iii) omit sub-paragraph (3);

(iv) in sub-paragraph (3A), omit “using the Part IIB assessment process”;

(v) in sub-paragraph (5), for “examinations board” substitute “College of Policing”;

(vi) omit sub-paragraph (6);

(vii) in sub-paragraph (7), after “Part II” omit “B”;

(f) in paragraph 6—

(i) for each of the three references to “examinations board” substitute “College of Policing”;

(ii) for each of the two references to “their” substitute “its”.

7. In Schedule 2—

(a) in paragraph 3, after condition C(4) insert “C(5) the pass must have been obtained before 1st April 2015.”;

(b) after the entry numbered 11 in the table, insert the following entry—

Section 50 was amended by paragraph 3 of Schedule 22 to the Criminal Justice and Immigration Act 2008 (c. 4) , section 3 of the Policing and Crime Act 2009 (c. 26) , section 82(12) of, and paragraph 32 of Schedule 16 to, the Police Reform and Social Responsibility Act 2011 (c. 13) ; section 27 of, and paragraphs 22 and 23 of Schedule 8 to, the Public Service Pension Schemes Act 2013 (c.25) ; and section 123(1) of the Anti-Social Behaviour, Crime and Policing Act 2014 (c. 12) .

Section 50(2ZC) was inserted by section 123(1) of the Anti-Social Behaviour, Crime and Policing Act 2014, with effect from 13th May 2014 ( S.I. 2014/949 ). Section 123 was the subject of a correction slip published on 4th August 2014.
