The Hartpury College (Transfer to the Higher Education Sector) Order 2018

The Secretary of State for Education makes the following Order in exercise of the powers conferred by section 122A(1) of the Education Reform Act 1988( 1 ).
In accordance with section 122A(1) of the Education Reform Act 1988, it appears to the Secretary of State that the full-time equivalent enrolment number of the institution conducted by Hartpury College for courses of higher education exceeds 55 per cent of its total full-time equivalent enrolment number.
Citation, commencement and application
1. —(1) This Order may be cited as the Hartpury College (Transfer to the Higher Education Sector) Order 2018 and comes into force on 13th September 2018.
(2) This Order applies in relation to England.
Transfer to the higher education sector
2. On 13th September 2018, Hartpury College( 2 ) is transferred to the higher education sector.

1988 c. 40 ; section 122A was inserted by section 74(1) of the Further and Higher Education Act 1992 (c. 13) . Section 122A is amended by section 90 of, and paragraph 4 of schedule 8 to, the Higher Education and Research Act 2017 (c. 29) , which has not yet come into force. By virtue of the National Assembly for Wales (Transfer of Functions) Order 1999 ( S.I. 1999/672 ), as amended by S.I. 2000/1829 , the power in section 122A is exercisable by the Secretary of State only in relation to England.
Hartpury College, whose address is Hartpury House, Hartpury, Gloucester GL19 3BE, was incorporated under section 15 of the Further and Higher Education Act 1992 (c.13) by the Education (Further Education Corporations) Order 1992 ( S.I. 1992/2097 ).
