The Public Service (Civil Servants and Others) Pensions (Amendment) Regulations 2020

Coming into force in accordance with regulation 1(2)

The Minister for the Civil Service makes these Regulations in exercise of the powers conferred by section 3 of, and paragraph 9 of Schedule 3 to the Public Service Pensions Act 2013( 1 ).

In accordance with section 22(2)(a) of that Act, the Minister has consulted representatives of such persons as appear to him likely to be affected by these Regulations with a view to reaching agreement.

In accordance with section 22(2)(b) of that Act, the Minister has laid a report before Parliament.

In accordance with section 3(5) of that Act, these Regulations are made with the consent of the Treasury.

Citation and commencement

1. —(1) These Regulations may be cited as the Public Service (Civil Servants and Others) Pensions (Amendment) Regulations 2020.

(2) These Regulations come into force on 1st April 2020, save for regulation 4, which comes into force on 1st September 2020.

Amendment of the Public Service (Civil Servants and Others) Pensions Regulations 2014

2.The Public Service (Civil Servants and Others) Pensions Regulations 2014( 2 ) are amended as follows.

Amendment of regulation 134

3. In regulation 134( 3 ) (rate of member contributions), in paragraph (8), after the table headed “Scheme Year 1st April 2018 to 31st March 2019 and Scheme Year 1st April 2019 to 31st March 2020” insert the following table—

Scheme Year 1st April 2020 to 31st March 2021

Annualised rate of pensionable earnings Member contributions rate
Up to but not including £22,601 4.6%
£22,601 to but not including £54,901 5.45%
£54,901 to but not including £150,001 7.35%
£150,001 and above 8.05%

Amendment of regulation 135

4. In regulation 135( 4 ) (amount of pensionable earnings), after paragraph (4) insert

(5) For the purpose of regulation 134, when calculating a member’s annualised rate of pensionable earnings, the amount of a payment of a member’s pensionable earnings for a pay period excludes any amounts paid to the member in that pay period in the form of arrears of, or back-dated, pensionable earnings. .
