The Lord Chancellor makes these Regulations in exercise of the powers conferred by sections 2(3) and 41(1)(a) and (b), (2)(a) and (b) of the Legal Aid, Sentencing and Punishment of Offenders Act 2012( 1 ).

Citation, commencement, interpretation and extent

1. —(1) These Regulations may be cited as the Criminal Legal Aid (Remuneration) (Amendment) (Amendment) Regulations 2022 and come into force at 11.00 p.m. on 29th September 2022.

(2) In these Regulations, “ the 2022 Regulations ” means the Criminal Legal Aid (Remuneration) (Amendment) Regulations 2022 ( 2 ).

(3) These Regulations extend to England and Wales.

Amendments to the 2022 Regulations

2. —(1) Schedule 3 to the 2022 Regulations is amended as follows.

(2) In the table following paragraph 1 (litigators’ fees for proceedings in the Court of Appeal), in the column that is headed “rate”—

(a) in the sixth row of that column (Attendance at court where more than one representative assigned, Senior Solicitor), for “£43.33” substitute “£44.33” ;

(b) in the seventh row of that column (Attendance at court where more than one representative assigned, Solicitor, legal executive or fee earner of equivalent experience), for “£35.63”, substitute “£35.68” .

(3) In the table following paragraph 2 (advocates’ fees for proceedings in the Court of Appeal), in the column that is headed “Attendance at consultation, conferences and views”—

(a) for “£19.26” substitute “£38.53” ;

(b) for “£16.75” substitute “£19.26” .
