The Lord Chancellor makes these Regulations in exercise of the powers conferred by section 2(3) and 41(1)(a) and (b) of the Legal Aid, Sentencing and Punishment of Offenders Act 2012( 1 ).
Citation, commencement and extent
1. β(1) These Regulations may be cited as the Criminal Legal Aid (Remuneration) (Amendment) (No. 4) Regulations 2023 and come into force on 16th November 2023.
(2) These Regulations extend to England and Wales.
Amendments to the Criminal Legal Aid (Remuneration) Regulations 2013
2. β(1)The Criminal Legal Aid (Remuneration) Regulations 2013( 2 ) are amended as follows.
(2) In paragraph 13A(1) of Schedule 1 (fee for video recorded cross-examination or re-examination), for βΒ£670β, substitute βΒ£1000β .
(3) In the table following paragraph 2(8) of Schedule 4 (police station attendance β fixed fees and escape fee thresholds), in the entry for the βLlanelliββScheme in the Criminal Justice System Area of βDyfed Powysββ
(a) in the βFixed Fee (Β£)β column, for β159.51β substitute β204.63β ; and
(b) in the βEscape Fee Threshold (Β£)β column, for β490.29β substitute β656.42β .
Application
3. The amendments made by these Regulations apply to cases where a determination under section 13 (advice and assistance for individuals in custody) or section 16 (representation for criminal proceedings) of the Legal Aid, Sentencing and Punishment of Offenders Act 2012 is made on or after 16th November 2023.
