The Secretary of State makes these Regulations in exercise of the powers conferred by sections 88(1) and (2) and 272(7) and (8) of the National Health Service Act 2006(1).

Citation, commencement, extent and application

1.—(1) These Regulations may be cited as the National Health Service (General Medical Services Contracts) (Prescription of Drugs etc.) (Amendment) Regulations 2025.

(2) These Regulations come into force on 1st October 2025.

(3) These Regulations extend to England and Wales and apply in relation to England only(2).

Amendments to Schedule 2 to the National Health Service (General Medical Services Contracts) (Prescription of Drugs etc.) Regulations 2004

2. In Schedule 2 to the National Health Service (General Medical Services Contracts) (Prescription of Drugs etc.) Regulations 2004(3) (drugs, medicines and other substances that may be ordered only in certain circumstances)—

(a)in column 1 of the table (drugs), in the entry relating to drugs for the treatment of erectile dysfunction, omit “Tadalafil” and “Vardenafil”;

(b)in column 1 of the table, in the entry relating to drugs for the treatment of erectile dysfunction, after the entry for “Avanafil” insert “Cialis” and “Levitra”;

(c)in column 2 of the table (patient), in the entry relating to “Oseltamivir (Tamiflu)” omit sub-paragraph (a) in paragraphs (1) and (2) and in the entry relating to “Zanamivir (Relenza)” omit sub-paragraph (a) in paragraph (1).
