The Secretary of State makes these Regulations in exercise of the powers conferred by Articles 18(3) and 19(5) of Council Regulation (EC) No 338/97 on the protection of species of wild fauna and flora by regulating trade therein(1) (“the Council Regulation”).
The Secretary of State has consulted the scientific authority(2) in accordance with Article 19(5) of the Council Regulation.
Citation, commencement and extent
1.—(1) These Regulations may be cited as the Trade in Endangered Species of Wild Fauna and Flora (Council Regulation (EC) No 338/97) (Amendment) Regulations 2026 and come into force on 6th March 2026.
(2) These Regulations extend to England and Wales, Scotland and Northern Ireland.
Amendments to the Annex to Council Regulation (EC) No 338/97
2. The Annex to Council Regulation (EC) No 338/97 on the protection of species of wild fauna and flora by regulating trade therein(3) is amended as follows.
Amendments to Notes on interpretation of Annexes A, B, C and D
3. In the section headed “Notes on interpretation of Annexes A, B, C and D”—
(a)in the annotations following paragraph 12—
(i)in annotation #4, in subparagraph (f)—
(aa)after “finished products” insert “packaged and ready for retail trade”;
(bb)omit “packaged and ready for retail trade and”;
