The Secretary of State makes these Regulations in exercise of the powers conferred by section 8C(1) and (2) of, and paragraph 21 of Schedule 7 to, the European Union (Withdrawal) Act 2018(1).

In making these Regulations, the Secretary of State has had special regard to the matters listed in section 46 (and regard to the guidance issued under section 46A) of the United Kingdom Internal Market Act 2020(2).

Citation, commencement and extent

1.—(1 ) These Regulations may be cited as the Windsor Framework (Retail Movement Scheme: Plant Health) (Amendment) Regulations 2026.

(2 ) These Regulations come into force on 15th October 2026.

(3 ) These Regulations extend to England and Wales and Scotland.

Commission Implementing Regulation (EU) 2019/2072 establishing uniform conditions for the implementation of Regulation (EU) 2016/2031 of the European Parliament and the Council, as regards protective measures against pests of plants

2.—(1) Commission Implementing establishing uniform conditions for the implementation of Regulation (EU) 2019/2072 of the European Parliament and the Council, as regards protective measures against pests of plants(Regulation (EU) 2016/20313) is amended as follows.

(2) In Annex 7, in Part A (plants, plant products and other objects originating in third countries which may only be introduced into Great Britain if special requirements are met)—

(a)in the table, after entry 30A., insert—

30B. Rhizomes of Zingiber officinale Roscoe, other than plants for planting Any third country, other than EU Member States, Liechtenstein and Switzerland

The rhizomes must be accompanied by an official statement that they:

(a)

originate in a country which, in accordance with the measures specified in ISPM4, is known to be free from Ralstonia pseudosolanacearum Safni et al.,

(b)

originate in an area* which, in accordance with the measures specified in ISPM4, is known to be free from Ralstonia pseudosolanacearum Safni et al., or

(c)

originate in a site of production which complies with the following:

(i)

it has been registered and supervised by the national plant protection organisation in the country of origin,

(ii)

official inspections of the site of production and its immediate vicinity have been carried out prior to harvest, and no presence or signs of Ralstonia pseudosolanacearum Safni et al. have been found,

(iii)

prior to export, a representative sample of the plants has been tested using appropriate molecular methods and found free from Ralstonia pseudosolanacearum Safni et al., and

(iv)

information ensuring traceability to that site of production has been secured during movement of the plants prior to export.

*The name of the area(s) must be included in the phytosanitary certificate under the heading “Place of origin”.;

(b)in the table, at entry 102B., in column (2) (origin)—

(i) after “Iraq,” insert “Israel,” ;

(ii) after “Syria,” insert “Taiwan,” .
